Update: I took this company to small claims court and won! I finally got my money back, but it’s pretty sad I had to go to court in order for that to happen.There are 2 issues here:1) I made an order to rent standard trees, and no longer need the rental since everything is cancelled. I never requested anything custom to be made, and their argument is that they created custom trees for me to rent, even though I chose items on their list available to rent. As a consumer, if I rent something that means I exchange money to hold a thing of value for a specified amount of time. If I pay money and don’t receive anything of value, that’s not a valid contract for a rental.2) The new order for the State of CA mandates closure of all non-essential retail businesses and prohibiting deliveries except for supplying essential businesses or delivering to essential infrastructure. The mandate says violations are a crime. Unfortunately, based on the definitions outlined in the order, Make Be-Leaves and delivery of orders from Make Be-Leaves are not considered part of the exempted essential businesses and functions.My event was cancelled for unforeseen circumstances and I wasn’t able to rent from this company, and after asking for my deposit back, I was refused a refund. This company had a lawyer send me a letter offering half of my money back as a “compromise,” which was hardly fair.Terrible business to try to profit off of a rental that can’t happen due to a pandemic and declared state/national emergency, and refuse to return someone’s money.
